The Cookie Law
Since April 1, 2012, a new regulation on the processing of information through cookies on websites has been added to the laws on advertising and e-commerce, which is mandatory for all online stores.
This new regulation, commonly referred to as the “Cookie Law”, obliges online store owners to clearly inform users and obtain express consent for the use of Cookies.
What are cookies?
Cookies are small data files that store information and are stored in the user’s browser, are to provide more information about users, allowing to remember different parameters and information about the customer, for analysis on the behavior of the same.
There are several types of cookies, classified according to their purpose or object:
What does the cookie law oblige?
The two main mandatory guidelines are: Transparency and the obligation to obtain consent.
In addition, although changes can be made in the modification of your cookies, they must always be in accordance with the obligations of Art. 22.2 of the LSSI, being technologically neutral and must provide solutions recognizable by most browsers so that they recognize it.
As for the first obligation, transparency, all users must receive clear, concise, and comprehensive information about the use of storage media and data retrieval. In other words, user data must be processed in a transparent manner so that users can easily understand how their data is being processed.
On the other hand, consent is considered the basis for compliance with the regulations. It is absolutely mandatory to provide the user with an “accept” button or any other similar formula, giving him/her the possibility to be informed about the processing of his/her data.
To comply with this section, the user has to accept it, any other action by the user, including omission, means a rejection of the proposal of acceptance.
What happens if I do not comply with the cookie law?
Before addressing this area, remember that it is always best to comply with the law. As we will see below, the return on non-compliance is zero.
Although this question should not be asked, it does not hurt to know the penalties you could face for non-compliance or ignorance of the law.
Thus, if the data controller does not do its job properly, or does not even do it at all, the LOPD stipulates a series of financial penalties that vary according to the infringement committed. This will be imposed by the Spanish Data Protection Agency (AEPD):
The sanctions and their severity can be found in article 38 of the LSSI-CE (Law of Information Society Services and Electronic Commerce).
